Why can't the real person be in their true story movie?

Right before a movie starts it will say, "Based on a true story." I was wondering about this today when I was watching Patch Adams. Sometimes I would look up their name and they are still alive. So I was wondering why can't they be in the true story movie? Do they get royalty if a director does a movie about them?
